Development without approval

Aviaries

You don’t need permissions from council to build or install an aviary if:

  • It is for domestic use only

Number

  • There are no more than 2 per property

Size

  • In a rural zone it is;
    • no larger than 30sqm
    • no taller than 3m
  • In all other zones it is;
    • no larger than 10sqm
    • no taller than 2.4m

Location

  • In a rural zone it is;
    • 20m from any road boundary
    • a minimum of 5m from all boundaries
  • In all other zones it is;
    • in the back yard
    • a minimum of 900mm from the side and rear boundaries

Other

  • The floor is to be impervious
  • The disposal of any roof water must not cause a nuisance to adjoining owners
  • In residential zones, any metal parts of the structure are to be low reflective, factory pre coloured materials
  • If your house is located on bushfire prone land and the aviary is going to be located less than 5m from your house or a neighbours house the aviary must be constructed of non-combustible materials

You do need permission to install an aviary if:

  • You do not meet all of the above requirements
  • Your property is in a foreshore area
